Şirketimiz tarafından geliştirilen Scorp uygulamalarının (“Loka Uygulamaları”) kullanıcılarındansanız, Türkiye’de kurulu İstanbul adresinde yer alan Loka Digital Medya Reklamcılık ve Teknoloji A.Ş. (“Loka”) olarak; veri sorumlusu sıfatıyla, kişisel verilerinizi ne amaçlarla işleyeceğimizi size anlatmak için bu Aydınlatma Metni’ni hazırladık. Veri sorumlusu sıfatıyla kişisel verilerinizi bu metinde belirtildiği şekilde, temel hak ve özgürlüklerinize halel gelmeden, hukuka uygun şekilde topladığımızı ve işlediğimizi bildiririz.

Kimlik Verisi

Ticari ilişkimizin kurulması ve Loka Uygulamalarını kullanabilmeniz için sizden aldığımız kullanıcı adı, ad, soyadı, cinsiyet gibi kişisel kimlik verilerinizi toplamakta ve işlemekteyiz.

İletişim Verisi

Sizlerle ürünlerimizi tanıtmak için iletişim kurmak, öneri ve şikayetlerinizi değerlendirmek ve çözüme ulaştırmak amacıyla e-mail adresi, bulunduğunuz ülke gibi verilerinizi toplamakta ve işlemekteyiz.

Finansal Veri

Yasal yükümlülüklerimizi yerine getirmek ve aramızdaki ilişki kapsamında gerekli finansal takibi gerçekleştirebilmek için online cüzdan bilgileri ve uygulama içi satın almalar gibi verileri işlemekteyiz.

Sizinle, hizmetlerimizi Loka Uygulamaları aracılığıyla sunmak ve yönetmek hususundaki meşru menfaatimiz gereği ve Loka Uygulamaları aracılığıyla hizmetlerimizin sunulması ve ödemelerin gerçekleştirilmesi gibi sözleşmesel yükümlülüklerimizi yerine getirmek amacıyla kişisel verilerinizi Loka Uygulamalarına kaydetmeniz ve uygulama kullanım verilerinin kaydedilmesi yoluyla topluyoruz.

Başvurunuzda yer alan talepleriniz, talebin niteliğine göre en geç otuz gün içinde ücretsiz olarak sonuçlandırılacaktır. Ancak, işlemin Şirket için ayrıca bir maliyeti gerektirmesi hâlinde, Kişisel Verileri Koruma Kurulu tarafından Veri Sorumlusuna Başvuru Usul Ve Esasları Hakkında Tebliğ ’de belirlenen tarifedeki ücret alınabilir.  


Kişisel verilerinizin işlenmesi ile ilgili hususlarda başvurunuzu Şirketin internet adresinde bulunan başvuru formunu doldurarak veya Veri Sorumlusuna Başvuru Usul Ve Esasları Hakkında Tebliğ ’in 5. maddesinde şartlara uymak kaydıyla aşağıdaki şekillerde yapabilirsiniz:



Şirket tarafından talebinizin niteliğine ve başvuru yönteminize göre Şirket tarafından başvurunun size ait olup olmadığının belirlenmesi ve böylece haklarınızı koruyabilmek amacıyla ek doğrulamalar (kayıtlı telefonunuza mesaj gönderilmesi, aranmanız gibi) isteyebiliriz. Örneğin Şirkette kayıtlı olan e-posta adresiniz aracılığıyla başvuru yapmanız halinde Şirkette kayıtlı başka bir iletişim yöntemini kullanarak size ulaşabilir ve başvurunun size ait olup olmadığının teyidini isteyebiliriz.

PRIVACY POLICY

Scorp recognizes that your privacy is very important and we take it seriously. This Privacy Policy (“Privacy Policy”) describes our policies and procedures on the collection, use, disclosure, and sharing of your personal information or personal data when you use the Scorp Platform. This Privacy Policy applies to activities by Scorp, Inc. and its affiliates and subsidiaries (collectively Scorp,” “we” or “us”). Capitalized terms that are not defined in this Privacy Policy have the meaning given to them in our Terms of Service. This Statement of Privacy applies to Scorp Web site including but not limited to mobile application and widgets and governs data collection and usage. By using the Scorp and the Service therein, you consent to the data practices described in this statement.

1. INFORMATION WE COLLECT
We collect information directly from individuals, from third parties, and automatically through the Scorp Platform.

Account and Profile Information.
We collect and store the information you provide to us when you signup and later configure your profile:
Your username, password and e-mail address when you register for a Scorp account.
Profile information that you provide for your user profile (e.g., first and last name, picture, phone number). This information allows us to help you or others be "found" on Scorp.
Your name, photo and profile description will be available for viewing to users of Scorp Platform.

Your Content.
We collect and store the information and content that you post to the Scorp Platform, including your posts, photos and comments. Unless you have posted certain content anonymously, Your Content, date and time stamps, and all associated mentions, likes and comments are publicly viewable on the Scorp Platform, along with your name. This also may be indexed by search engines and be republished elsewhere on the Internet in accordance with our Terms of Service. For more information about what you can change, see the below section on MODIFYING YOUR INFORMATION.

Communications.
When you communicate with us (via email, phone, through the Scorp Platform, or otherwise), we may maintain a record of your communication.

Integrated Service Provider and Linked Networks.
You can elect to sign in or sign up to the Scorp Platform through a linked network (i.e.Facebook), and you can connect your existing Scorp account with certain third party networks like Facebook (each a “Linked Network”). If you elect to sign up through or connect a Linked Network, we receive certain profile and account information about you from the Linked Network. These Linked Networks may also appear in your profile, so that people can find you on these Linked Networks. The specific information provided to us by Linked Networks is determined by these third parties and may vary by network. In all cases, the permissions page for the Linked Network will describe the information being shared. You should consult their respective privacy policies for information about their practices. You may elect to use information from the Linked Network to populate your profile on the Scorp Platform and help you find and follow your contacts on the Scorp Platform. You may also elect to connect and make and receive payments to and from use through third party networks (“Integrated Service Provider”); if you do so, you will be allowing us to pass to and receive from the Integrated Service Provider your login information and other user data for payment purposes.

Automatically Collected Information About Your Activity.
We use cookies, log files, pixel tags, local storage objects, and other tracking technologies to automatically collect information about your activities, such as your searches, page views, date and time of your visit, and other information about your use of the Scorp Platform. We also collect and may store information that your computer or mobile device provides to us in connection with your use of the Scorp Platform such as your browser type, type of computer or mobile device, browser language, IP address, mobile carrier, unique device identifier, location, and requested and referring URLs. We also receive information when you view content on or otherwise interact with the Scorp Platform, even if you have not created an account. For more information, see the “Cookies, Pixels and Tracking” section below and our Cookie Policy.


Cookies, Pixels and Tracking.
We and our third party providers use cookies, clear GIFs/pixel tags, JavaScript, local storage, log files, and other mechanisms to automatically collect and record information about your usage and browsing activities on the Scorp Platform and across third party sites or online services. We may combine this information with other information we collect about users. Below, we provide a brief summary these activities. For more detailed information about these mechanisms and how we collect activity information, see our Cookie Policy.

Engagement.
We collect browsing information – such as IP address and location, date and time stamp, user agent, Scorp cookie ID (if applicable), URL, unique advertising or content identifiers (if applicable) and time zone, and other information about user activities on the Scorp Platform. We may also receive information about you from third parties, such as other users, partners (including ad partners), or our affiliated companies.

Finding your friends on Scorp.
If you choose, you can use our "Find friends" feature to locate other people with Scorp accounts either through (i) your contacts list, (ii) third-party social media sites or (iii) through a search of names and usernames on Scorp Platform. If you choose to find your friends through (i) your device's contacts list, then Scorp will access your contacts list to determine whether or not someone associated with your contact is using Scorp. If you choose to find your friends through a (ii) third-party social media site, then you will be prompted to set up a link to the third-party service and you understand that any information that such service may provide to us will be governed by this Privacy Policy. If you choose to find your friends (iii) through a search of names or usernames on Scorp Platform then simply type a name to search and we will perform a search on our Service.

We do not sell your personal data – such as your name and contact information – to third parties to use for their own marketing purposes. Scorp uses the information we collect for the following purposes:

We share information as set forth below, and where individuals have otherwise consented:

Service Providers. We may share your information with third party service providers who use this information to perform services for us, such as payment processors, hosting providers, auditors, advisors, consultants, customer service and support providers, as well as those who assist us in providing the Ad Services.

Affiliates. The information collected about you may be accessed by or shared with subsidiaries and affiliates of Scorp, Inc., whose use and disclosure of your personal information is subject to this Privacy Policy.

Business Transfers. We may disclose or transfer information, including personal information, as part of any merger, sale, and transfer of our assets, acquisition or restructuring of all or part of our business, bankruptcy, or similar event.

Legally Required. We may disclose your information if we are required to do so by law.

Protection of Rights. We may disclose information where we believe it necessary to respond to claims asserted against us or, comply with legal process (e.g., subpoenas or warrants), enforce or administer our agreements and terms, for fraud prevention, risk assessment, investigation, and protect the rights, property or safety of Scorp, its users, or others.

Your Content and Activity. Your Content, including your name, profile picture, profile information, and certain associated activity information is available to other users of the Scorp Platform and may be viewed publicly. Public viewing includes availability to non-registered visitors and can occur when users share Your Content across other sites or services. In addition, Your Content may be indexed by search engines. See the section below about MODIFYING YOUR INFORMATION for information about how you may change how certain information is shared or viewed by others.

Metrics. We may share with users of our advertisers or publishers aggregate statistics, metrics and other reports about the performance of their ads or content in the Scorp Platform such as the number of unique user views, demographics about the users who saw their ads or content, conversion rates, and date and time information. We do not share IP addresses or personal information. We may also allow our advertisers or publishers to use Pixels on the Scorp Platform in order to collect information about the performance of their ads or content.

Anonymized and Aggregated Data. We may share aggregated or de-identified information with third parties for research, marketing, analytics and other purposes, provided such information does not identify a particular individual.

4. HOW WE STORE AND PROTECT YOUR INFORMATION

How we store your information.
Your information collected through the Service may be stored and processed in other countries which Scorp, its Affiliates or Service Providers maintain facilities. Scorp, its Affiliates, or Service Providers may transfer information that we collect about you, including personal information across borders and from your country or jurisdiction to other countries or jurisdictions around the world. By registering for and using the Service you consent to the transfer of information to any other country in which Scorp, its Affiliates or Service Providers maintain facilities and the use and disclosure of information about you as described in this Privacy Policy.

How We Protect Your Information.
We use commercially reasonable safeguards to help keep the information collected through the Service secure and take reasonable steps (such as requesting a unique password) to verify your identity before granting you access to your account. However, Scorp cannot ensure the security of any information you transmit to Scorp or guarantee that information on the Service may not be accessed, disclosed, altered, or destroyed. Please do your part to help us. You are responsible for maintaining the secrecy of your unique password and account information, and for controlling access to emails between you and Scorp, at all times. Your privacy settings may also be affected by changes the social media services you connect to Scorp make to their services. We are not responsible for the functionality, privacy, or security measures of any other organization.

5. MODIFYING YOUR INFORMATION
You may update or correct your account information at any time by logging in to your account. You may also make a number of other adjustments to settings or the display of information about you. You may, of course, decline to submit information through the Scorp Platform, in which case we may not be able to provide certain services to you. You may also control the types of notifications and communications we send, limit the information shared within the Scorp Platform about you, and otherwise amend certain privacy settings. Here is some further information about some of your choices:

Anonymous Posts. You may post certain content anonymously, including videos. In such event, your name is not displayed along with the content

Your Content. You may delete the videos that you post at any time. Any videos you have posted may remain on the Scorp Platform. Any deleted content will be removed from third party sites from which it has been shared as a link via Scorp's standard sharing features; however we have no control over deletions or changes to Your Content if it has been shared manually by others or has been shared in a video format.

Emails and Communications. When you join the Scorp Platform by signing up for an account or creating a profile, as part of the service, may receive emails from Scorp regarding to updates or relevant content for you. You can manage your email in your account profile settings. If you remove your email from your account you will no longer receive emails from us.
Third parties may comment on your postings within the Scorp Platform. In your profile, under your Privacy Settings, you can adjust who can comment on your posts. You can also adjust permissions about who you allow to send you messages on the Scorp Platform.

Followers. You can block the ability of another Scorp user to follow you by selecting the setting for this in the other user’s profile. You can change whether or not you follow other users. When you block a user he will no longer will be able see content you have posted such as your profile information, posts or comments.

Categories. You can change categories that you follow from your profile in Content Settings.

Deleted or Deactivated Account. If you choose Delete Your Account in your privacy settings, then all of Your Content will be removed from public visibility on the Scorp Platform, and it may not be restored by us, even if you change your mind. If you choose Deactivate Your Account, then you will no longer receive any communications from us, and users will not be able to interact with you; however Your Content will remain on the Scorp Platform. Once you deactivate your account, you can reactivate it any time by choosing to log in.

6. PROTECTION OF PERSONAL INFORMATION
Scorp takes precautions — including administrative, technical, and physical measures — to safeguard your personal information against loss, theft, and misuse, as well as against unauthorized access, disclosure, alteration, and destruction. In case of suspicious account activity or a breach in security, Scorp notifies its users about the condition and the risks.
Scorp uses Secure Sockets Layer (SSL) encryption on all web pages where personal information is collected.

The Scorp Platform may contain links to third party sites or online services. We are not responsible for the practices of such third parties, whose information practices are subject to their own policies and procedures, not to this Privacy Policy.

9. TRANSFERRING YOUR DATA
Scorp is headquartered in the Turkey, and has operations, entities and service providers in the Turkey and throughout the world. Our main service provider is AWS and your data is stored in AWS data centers reside in Frankfurt. As such, we and our service providers may transfer your personal information to, or access it in, jurisdictions that may not provide equivalent levels of data protection as your home jurisdiction. We will take steps to ensure that your personal information receives an adequate level of protection in the jurisdictions in which we process it.

10. CHILDREN’S PRIVACY
Scorp does not knowingly collect or solicit any information from anyone under the age of 18 or knowingly allow such persons to register for the Service. The Service and its content are not directed at children under the age of 18. In the event that we learn that we have collected personal information from a child under age 18 without parental consent, we will delete that information as quickly as possible. If you believe that we might have any information from or about a child under 18, please contact us at support@scorpapp.com.

If we change our privacy policies and procedures, we will post those changes on this page. We reserve the right to make changes to this privacy policy without advance notice. However, if we make any changes to this Privacy Policy that materially change how we treat your personal information, we will endeavor to provide you with reasonable notice of such changes, such as via prominent notice in the Scorp Platform or to your email address of record.

TERMS AND CONDITIONS OF USE

ATTENTION: By accessing or using the SCORP website, the SCORP service, or any applications (including mobile applications) made available by SCORP (hereinafter referred to as the “Service”), you agree and affirm that you have read and accept these terms of use. The Service is owned or controlled by SCORP. By using the Service, you indicate your acceptance of these terms and conditions of use. If you do not accept these terms and conditions of use, please do not use this Service.
There may be times when we offer a special feature that has its own terms and conditions that apply in addition to these Terms of Use. In those cases, the terms specific to the special feature control to the extent there is a conflict with these Terms of Use.
Your use of the Service forms a legal agreement between you and SCORP and is subject to the terms of this agreement as stated in Terms and Conditions of Use. You acknowledge and agree that SCORP may stop (permanently or temporaliy) providing the Services to you or to users generally, at SCORP’s sole discretion, without prior notice to you. You may stop using the Service at any time. You do not need to specifically inform SCORP when you stop using SCORP. In order to access certain Materials and Services, you may be required to provide information about yourself (such as identification or contact details) as part of your continued use of the Services. You agree that any registration information you give to SCORP will always be accurate, correct and up to date.



Basic Terms

You must be at least 18 years old to use the Service.
By posting to the Service, you agree to be solely responsible for the content of all information you contribute, link to or otherwise upload.
You agree that everything you post shall be truthful, accurate, not misleading and offered in good faith, and that you have the right to post such content/material.
You agree not to post false, misleading or deceptive comments, materials for which SCORP does not own the IP rights or have the right to reproduce/upload, trademarked materials, or materials that contain confidential material or violate third party’s right of publicity, any photos or comments that depict unsafe practices, offensive behavior, profanity, personal attacks and illegal statements, content attempting to impersonate someone else including but not limited to customers, clients and employees of the Service, content that is subject to an internal investigation or that refers to, or otherwise speaks to, ongoing litigation matters or investigations.
You agree to keep it appropriate and polite when disagreeing with others’ opinions.
You must not create or submit unwanted email, comments, likes or other forms of commercial or harrassing communications to any SCORP users.
You agree that your submission does not contain or constitute any unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other form of solicitation and any viruses, worms, spyware, adware or other potentially damaging programs or files.
You will not be compensated or granted any consideration by any third party as regards your posts.
You agree that your submission does not violate any law (including, but not limited to, those governing export control, consumer protection, unfair competition, anti-discrimination or false advertising),
You agree that you will not upload files that contain software or other material protected by intellectual property laws (or by rights of privacy of publicity) unless you own or control the rights thereto or have received all necessary contents.
You agree that you will not download any file posted by another user of the Service that you know, or reasonably should know, cannot be legally distributed in such manner.
You agree that you will not restrict or inhibit any other user from using and enjoying the Service.
You agree that you will not harvest or otherwise collect information about others, including e-mail addresses, without their consent.
You must not change, modify, adapt or alter the Service or change, modify or alter another website so as to falsely imply that it is associated with the Service.
You must not use domain names or web URLs in your username without prior consent from SCORP.
You must not create accounts with the Service through unauthorized means, including but not limited to, by using an automated device, script, bot, spider, crawler or scraper.
SCORP may provide in the future API and in this case you must not access SCORP’s private API by means other than those permitted by SCORP. Use of SCORP’s API is subject to a separate set of terms.
You agree to release and indemnify SCORP and sponsors of SCORP websites from any claims and/or liability related to your use of the Websites.
By submitting any user submission, you represent and warrant that your submission will not and may not be reasonably considered to be, defamatory, libelous, hateful, racially, ethnically, religiously, or otherwise biased or offensive, unlawfully threatening or unlawfully harassing to any individual, partnership, or corporation, vulgar, pornographic, obscene, or invasive of another’s privacy.
You agree that you are responsible for all data charges you incur through use of the Service.
We prohibit crawling, scraping, caching or otherwise accessing any content on the Service via automated means, including but not limited to, user profiles and photos (except as may be the result of standard search engine protocols or technologies used by a search engine with SCORP’s express consent).

Violation of these Terms of Use may, in SCORP’s sole discretion, result in termination of your SCORP account. You understand and agree that SCORP cannot and will not be responsible for the content posted on the Service and you use the Service at your own risk. If you violate the letter of spirit of these terms of use, or otherwise create risk or possible legal exposure for SCORP, we can stop providing all or part of the Service to you.

Feature of the Service - Utility Token

SCORP offers a feature allowing users to purchase utility "Coins" for use within the Service (i.e., as a "tip" to another SCORP users for their archived video). You acknowledge and agree that your distribution of any Coins currently in your account, as a "tip" to any other user's account, is made solely at your own discretion; you further understand that once you have confirmed a transfer of Coins from your account to another user's account, the action cannot be undone, and the Coins cannot be withdrawn.
The value (i.e., the exchange rate) of the Coins is determined by SCORP based on your country of origin, and SCORP further reserves the right to modify the purchase exchange rate between actual currency and utility Coins from time to time, with or without reason, in its sole discretion. By your use of the Service, you confirm your understanding of and accept the then-current exchange rate of any Coins at the time of your purchase.
Your use of any Coins purchased shall be solely for legitimate purposes within the Service and must comply with all applicable laws at all times (i.e., no exchanging of Coins for any activity, product, conduct, or services deemed unauthorized by these Terms of Use or our Community Policy).
Any Coins stored in your personal Service account in excess of Two Thousand Seven Hundred Eighty (2,780) Gift Points, either by your own receipt or by receipt from another user (i.e., receipt of a "tip") may be "cashed out" (i.e., exchanged) for actual fiat currency. The value of said fiat currency to be cashed-out shall be determined by SCORP's then-current exchange rate and might be subject to a production fee as set forth and deducted by the applicable financial service provider, as determined by SCORP at the time of the transfer, and a service fee as set forth and might be deducted by SCORP. You agree and acknowledge that the value of the Coins and Gift Points may change between the time they were purchased and the time you decide to cash-out.

Pricing and Payment

If you would like to send gifts to someone for their videos on SCORP, you must purchase and pay the equivalent SCORP coin using real money. The app store may be subject to a sales tax in your area. (You can check the Terms of Service of your app store for more details)
IMPORTANT: All SCORP coins are not refundable. You understand and agree that your purchase of SCORP coins in the SCORP application or the purchase of other special features is a reflection of the buying behavior. SCORP has no obligation to provide you with any reason for a refund.
If you cancel your order through the app store after you have purchased the coins in the application, we will withdrawal the coins we have sent and other virtual goods or physical services (including but not limited to rank, experience, rank, etc.) together. The circumstances are serious, SCORP will reserve the right to disable your account and withdrawal all the coins in the account.
IMPORTANT: You agree that we will make the necessary corrections and adjustments when your account balance is incorrect due to SCORP system maintenance or other technical failures.
IMPORTANT: All users do not allow to trade SCORP coins or accounts privately. You understand and agree that if you trade SCORP coins or account privately, SCORP reserve the right to disable your account and withdraw all the coins in your account.

Features of the Service - Shuffle Space Boost

Scorp reserves right to remove inappropriate profiles from Shuffle Space Boost feature without refunding. Please make sure your profile description and/or profile picture do not contain nudity or offensive content.
Intellectual Property The Service and its original content, features and functionality are and will remain the exclusive property of Scorp Inc. and its licensors. "Expected Monthly Income"
In a short video product, a user who uploads User Content (“Content Provider”) may be entitled to earn "Expected Income", based on our measurement of the popularity of the relevant User Content and other relevant factors (as determined by us in our sole discretion).
Admission to the Scorp's Partner Program is optional to the Content Providers. Content Providers can chose to opt in to the Partner Program and declare to accept the terms and conditions stated here by doing so. Scorp withholds the right to accept, reject, and remove Content Providers from its Partner Program at any time. Conditions for being eligible to apply for the Partner Program in first place are determined by us in our sole discretion and are open to change without prior notice. Scorp holds the right to withhold an explanation from the Content Provider in question and remaining Content Providers for accepting, rejecting, and removing any Content Provider to/from the Partner Program.
At any point, a Content Provider can see how much "Expected Income" he/she has accrued on a real-time basis by checking the Partner Program page (accessed from user's own profile within the app) if they are part of the Partner Program. "Expected Income" cannot be exchanged for any virtual currency in Scorp, or transferred between users or user accounts.
A Content Provider can choose, by selecting the relevant options in their Partner Program page, to withdraw "Expected Income" in exchange for monetary compensation (to be denominated in Turkish Lira). The applicable monetary compensation will be calculated by us based on various factors including the amount of a user’s "Expected Income". The withdrawal of "Expected Income" will be subject to the following terms and any additional information provided in the Withdrawal Instructions that are provided to you at the time of such withdrawal, including the applicable daily and monthly limits on withdrawal amounts:
Although we aim to fulfil all withdrawal requests in a timely manner, we do not guarantee fulfilment within a specific period of time (including any estimated timings set out at the time of withdrawal) and we will not be liable to you or any third party for any failure to fulfil a withdrawal request within such time.
If you wish to convert the amount into a currency other than TL (Turkish Lira), this option may be available within your bank account of the IBAN provided (or other payment channel if applicable) account but this is at the discretion of bank account of the IBAN provided (or other payment channel if applicable) and the terms and conditions of bank account of the IBAN provided (or other payment channel if applicable), including any applicable fees, will apply to such currency conversion.
If you are subject to any taxes imposed by any jurisdiction on these payments, you will be responsible for the payment of such taxes (including any related penalties or interest) to the relevant tax authority. We reserve the right to deduct any applicable taxes prior to making such payment if we determine that we are required to do so by applicable law. We also reserve the right to request certifications from you in relation to taxes and to report to tax authorities amounts paid and/or withheld from payments to you.
We reserve the right to deduct "Expected Income" from your account if you are in breach of these Terms. We may cancel the operation of the "Expected Income" incentive at any time and on limited or no notice. If we cancel the "Expected Income" incentive, you shall have no right or entitlement to any financial compensation in respect of any "Expected Income" accrued prior to the date of cancellation of the initiative that has not been converted into cash using the mechanism set out in these Terms.
If a Content Provider has separately entered into a Partner Program Agreement (a “PP Agreement”) with us, the terms of the PP Agreement shall prevail over these Terms in the event of any conflict.

Account Termination Policy

SCORP reserves the right to decide whether any Content or activity, in whole or in part, violates these Terms of Service or our Community Policy, and SCORP may at any time, without prior notice and in its sole discretion, terminate your account or cease providing you with all or part of the Service, or remove such Content if we reasonably believe: (i) you have otherwise violated of these Terms of Service or our Community Policy, (ii) you create risk or possible legal exposure for us; (iii) your account should be removed due to prolonged inactivity; or (iv) our provision of the Service to you is no longer commercially viable. We will make reasonable efforts to notify you by the email address associated with your account or the next time you attempt to access your account, depending on the circumstances.
If SCORP terminates your account for cause, as determined in its sole discretion, you agree and acknowledge that all of or your digital records, including but not limited to virtual in-app currency (i.e. Coins, gift points, gifts, etc.) chat logs, user comments, profile photos, videos and any data generated and stored on the Service will be confiscated, with or without notice. In other words, play by the rules and adhere, to these Terms of Service, and the SCORP Community Policy; failure to do so will result in the loss of your account and all of its assets.
You may end your legal agreement with SCORP at any time by deactivating your account(s) and discontinuing your use of the Service.


TERMINATION AND MODIFICATION OF THESE TERMS OF USE

SCORP reserves the right to change the terms, conditions, and notices under which the Service is offered, including but not limited to the charges associated with the use of the web site.
We reserve the right to modify or terminate the Service or your access to the Service for any reason, without notice, at any time, and without liability to you. You can deactivate your SCORP account by logging into the Service and selecting deactivate from the account settings. If we terminate your access to the Service or you use the form detailed above to deactivate your account, your photos, comments, likes, friendships, and all other data will no longer be accessible through your account.
We reserve the right to refuse access to the Service to anyone for any reason at any time.
We reserve the right to force forfeiture of any username for any reason.
We may, but have no obligation to, remove, edit, block, and/or monitor Content or accounts containing Content that we determine in our sole discretion violates these Terms of Use.

LINKS TO THIRD PARTY SITES

SCORP website may contain links to other Web Sites (“Linked Sites”). The Linked Sites are not under the control of SCORP website. SCORP website is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. SCORP website is not responsible for webcasting or any other form of transmission received from any Linked Site. SCORP website is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by the SCORP Service.

RIGHTS

SCORP does not claim ownership of any Content that you post on or through the Service. Instead, you hereby grant to SCORP a non-exclusive, fully paid and royalty-free, transferable, sub-licensable, worldwide license to use the Content that you post on or through the Service, subject to the Service's Privacy Policy.
Some of the Service may be supported by advertising revenue and may display advertisements and promotions, and you hereby agree that SCORP may place such advertising and promotions on the Service or on, about, or in conjunction with your Content. The manner, mode and extent of such advertising and promotions are subject to change without specific notice to you.
You acknowledge that we may not always identify paid services, sponsored content, or commercial communications as such.
You represent and warrant that: (i) you own the Content posted by you on or through the Service or otherwise have the right to grant the rights and licenses set forth in these Terms of Use; (ii) the posting and use of your Content on or through the Service does not violate, misappropriate or infringe on the rights of any third party, including, without limitation, privacy rights, publicity rights, copyrights, trademark and/or other intellectual property rights; (iii) you agree to pay for all royalties, fees, and any other monies owed by reason of Content you post on or through the Service; and (iv) you have the legal right and capacity to enter into these Terms of Use in your jurisdiction.

In this scope, SCORP Content, especially the SCORP name and logo are trademarks of SCORP, and may not be copied, imitated or used, in whole or in part, without the prior written permission of SCORP, except in accordance with our brand guidelines. In addition, all page headers, custom graphics, button icons and scripts are service marks, trademarks and/or trade dress of SCORP, and may not be copied, imitated or used, in whole or in part, without prior written permission from SCORP. SCORP Content is protected by copyright, trademark, patent, trade secret and other laws, and, as between you and SCORP, SCORP owns and retains all rights in the SCORP Content and the Service. You will not remove, alter or conceal any copyright, trademark, service mark or other proprietary rights notices incorporated in or accompanying the SCORP Content and you will not reproduce, modify, adapt, prepare derivative works based on, perform, display, publish, distribute, transmit, broadcast, sell, license or otherwise exploit the SCORP Content.
Although it is SCORP’s intention for the Service to be available as much as possible, there will be occasions when the Service may be interrupted, including, without limitation, for scheduled maintenance or upgrades, for emergency repairs, or due to failure of telecommunications links and/or equipment. Also, SCORP reserves the right to remove any Content from the Service for any reason, without prior notice. Content removed from the Service may continue to be stored by SCORP, including, without limitation, in order to comply with certain legal obligations, but may not be retrievable without a valid court order. In other words, SCORP is not a backup service and you agree that you will not rely on the Service for the purposes of Content backup or storage. SCORP will not be liable to you for any modification, suspension, or discontinuation of the Services, or the loss of any Content. You also acknowledge that the Internet may be subject to breaches of security and that the submission of Content or other information may not be secure.
You agree that SCORP is not responsible for, and does not endorse, Content posted within the Service. SCORP does not have any obligation to prescreen, monitor, edit, or remove any Content. If your Content violates these Terms of Use, you may bear legal responsibility for that Content.
Except as otherwise described in the Service's Privacy Policy, as between you and SCORP, any Content will be non-confidential and non-proprietary and we will not be liable for any use or disclosure of Content. You acknowledge and agree that your relationship with SCORP is not a confidential, fiduciary, or other type of special relationship, and that your decision to submit any Content does not place SCORP in a position that is any different from the position held by members of the general public, including with regard to your Content. None of your Content will be subject to any obligation of confidence on the part of SCORP, and SCORP will not be liable for any use or disclosure of any Content you provide.
It is SCORP’s policy not to accept or consider content, information, ideas, suggestions or other materials other than those we have specifically requested and to which certain specific terms, conditions and requirements may apply. This is to avoid any misunderstandings if your ideas are similar to those we have developed or are developing independently. Accordingly, SCORP does not accept unsolicited materials or ideas, and takes no responsibility for any materials or ideas so transmitted. If, despite our policy, you choose to send us content, information, ideas, suggestions, or other materials, you further agree that SCORP is free to use any such content, information, ideas, suggestions or other materials, for any purposes whatsoever, including, without limitation, developing and marketing products and services, without any liability or payment of any kind to you.
You agree, confirm and undertake, by adding content, that given by you to SCORP, to the website, that you grant all kinds of Rights to use and benefit of content and enable to use and benefit from content with broadest scope and meanings designated by legislations for free (without demanding any fee) by adding content to the website.Unless otherwise indicated, Rights to use and benefit and enable to use and benefit include Rights to use, enable to use, benefit and enable to benefit on including Internet, but not limited to, all kinds of virtual platforms and other communication channels and other on-line and off-line platforms (television, radio, press etc.) within the scope of this article. USERNAME AND PASSWORD
 
You are responsible for maintaining the security of your account, passwords, and files. We will accept instructions of any individual who claims to be authorized to direct changes to your account so long as such person presents your username and password or provides other appropriate account identifying information as determined by us in our discretion, by email or by phone, or through a Third Party Service, if any, through which you access the SCORP website. We have no knowledge of your organizational structure, including if you are registering for the SCORP website as an entity, or your personal relationships, if you are a person. We shall not be responsible for the actions of any individuals who misuse or misappropriate your assets using your username and password or other appropriate account identifying information.

PROHIBITED CONTENT SCORP

During the KYC process, additional PEP and Sanction screening is completed by internal moderators for streamers in regions such as Ukraine and Russia.

Website prohibits the use of the Service by any person or entity that:
Provides, sells or offers to sell any of the following products or content (or services related to the same): pornography or illicitly pornographic sexual products, including but not limited to magazines, video and software; escort services; dating services; adult “swinger” promotions; illegal goods; illegal drugs; illegal drug contraband; pirated computer programs; instructions on how to assemble or otherwise make bombs, grenades or other weapons.
Displays or markets material that exploits children, or otherwise exploits children under 18 years of age.
Provides, sells or offers products, services or content frequently associated with unsolicited commercial email, a.k.a. spam, such as online and direct pharmaceutical sales, including but not limited to health and sexual well-being products, work at home businesses, credit or finance management, including but not limited to credit repair and debt relief offerings and stock and trading tips, and mortgage finance offers, DJ/nightclub, event/club promotions/party lists, and odds making and betting/gambling services, including but not limited to poker, casino games, horse and dog racing and college and pro sporting events.
Provides material that is grossly offensive, including blatant expressions of bigotry, prejudice, racism, hatred or excessive profanity or post any obscene, lewd, lascivious, filthy, excessively violent, harassing or otherwise objectionable content.
Posts or discloses any personally identifying information or private information about children without their consent (or their parents’ consent in the case of a minor).
Sells or promotes any products or services that are unlawful in the location at which the content is posted or received.
Introduces viruses, worms, harmful code and/or Trojan horses on the Internet.
Engages in any libelous, defamatory, scandalous, threatening, or harassing activity.
Posts any content that advocates, promotes or otherwise encourages violence against any governments, organizations, groups or individuals or which provides instruction, information or assistance in causing or carrying out such violence.
Markets to third party voter registration lists.
Provides content, including assets, of authors, artists, photographers or others without the express written consent of the content owner.

We may, in our sole discretion, immediately disable your access to Service if we believe, in our sole discretion, that you have violated any of the policies listed above or this Agreement.

You may not use any metatags or any other “hidden text” utilizing any name, trademark, or product or service name of SCORP without SCORP’s prior written permission. In addition, the look and feel of the website (including all page headers, custom graphics, button icons, and scripts) is the service mark, trademark, and/or trade dress of SCORP and may not be copied, imitated, or used (in whole or in part) without SCORP’s prior written permission. Reference to any products, services, processes, or other information, by trade name, trademark, or otherwise does not constitute or imply endorsement, sponsorship, or recommendation thereof by SCORP.

INDEMNIFICATION

You (and also any third party for whom you operate an account or activity on the Service) agree to defend (at SCORP's request), indemnify and hold the SCORP Parties harmless from and against any claims, liabilities, damages, losses, and expenses, including without limitation to, reasonable attorney's fees and costs, arising out of or in any way connected with any of the following (including as a result of your direct activities on the Service or those conducted on your behalf): (i) your Content or your access to or use of the Service; (ii) your breach or alleged breach of these Terms of Use; (iii) your violation of any third-party right, including without limitation, any intellectual property right, publicity, confidentiality, property or privacy right; (iv) your violation of any laws, rules, regulations, codes, statutes, ordinances or orders of any governmental and quasi-governmental authorities, including, without limitation, all regulatory, administrative and legislative authorities; or (v) any misrepresentation made by you. ATTENTION: By accessing or using the SCORP website, the SCORP service, or any applications (including mobile applications) made available by SCORP (hereinafter referred to as the “Service”), you agree and affirm that you have read and accept these terms of use. The Service is owned or controlled by SCORP. By using the Service, you indicate your acceptance of these terms and conditions of use. In order to access certain Materials and Services, you may be required to provide information about yourself (such as identification or contact details) as part of your continued use of the Services. You agree that any registration information you give to SCORP will always be accurate, correct and up to date.

CHANGES OF THE TERMS

Company may change the Terms from time to time, at its sole discretion and without any notice. We will notify You regarding substantial changes of these Terms on the homepage of the Site and/or we will send You an e-mail regarding such changes to the e-mail address that You provided in the registration form. Such substantial changes will take effect five (5) business days after such notice was provided on our website or sent by email.
